Custom Cube creator denied by Paramount

a hand made replica of the Allspark cube from the new Transformers movie
due to the personal labor hours he spent making this .. it was set up for sale on ebay

now he is not being allowed to even offer it up to recoup cost ..
apparently due to a copyright violation. ??

Now from a marketing stand point I can see where Paramount is comming from, however ... my question is, how is this any different than any other costom made TF figure sold on ebay ?

Thing is too, why make something like that, and then just sell it. Unless that was his intent in the first place, and if so, well, shame on him for only thinking of making something like that for personal profit.
